What 'Defensible' Actually Means
A letter gets challenged in one of two ways. Usually it is informal: a leasing office phones the professional who signed it and asks whether the letter is genuine. Occasionally it is formal, in a dispute before a fair housing agency or a court.
Both tests come down to the same two things. Was the signer licensed to practise in your state at the time, and did they actually evaluate you? Everything a service can honestly sell you is in service of those two answers.
The licensure question
A license is state-issued, checkable in a public register, and either current or not. A letter signed by someone licensed in a different state fails immediately, which is why matching you to a provider licensed where you live is non-negotiable rather than a feature.
The evaluation question
This is the softer one and where services differ most. A five-question form and a 20-minute clinical conversation are both described as an assessment in marketing copy. Only one of them gives the signer something to say if a landlord's lawyer asks what the opinion was based on.
The 7 Elements a Valid Letter Contains
Check any letter you are given against this list before you hand it to a housing provider. If something is missing, ask the professional to correct it — a missing license number is a trivial fix before you send it and a real problem afterwards.
- The signer's license type, license number and issuing state
- The date the letter was written
- A statement that the signer evaluated you
- A statement that you have a condition substantially limiting a major life activity
- A statement that the animal is part of your treatment
- Each animal named, with species
- The signer's signature and direct contact details
Notice what is absent. Your diagnosis does not need to be stated, and a housing provider generally cannot require it. A letter that volunteers more medical detail than necessary is not a stronger letter.
The Right Statute Matters
Housing accommodation for an assistance animal runs on the federal Fair Housing Act. The Americans with Disabilities Act covers public places and service animals, and it uses a narrower definition of assistance animal that excludes emotional support animals.
This is why an emotional support animal has housing rights but no right of entry to shops or restaurants. It is also why any service telling you an ESA letter grants 'full ADA protections' is either careless or misleading you — and if they are wrong about which law applies, that is a signal about the rest of their advice.

The 7 Questions Worth Asking Either Service
Is the provider licensed in your state?
This is the only thing that makes a letter work. A landlord verifies the license against a public state register, and a license from the wrong state fails immediately. Ask before you pay.
Is there a real evaluation?
A questionnaire that returns an instant decision is not a clinical evaluation. If a landlord phones the signer and finds no record of an assessment, the request fails.
When do they charge you?
Paying after approval and getting a refund after a denial are not the same thing. One never takes your money; the other takes it and returns it on the company's timetable.
Do they sell registrations, ID cards or vests?
No US registry, certificate or ID card gives an animal any legal right. A service selling them either doesn't know that or is counting on you not knowing.
What do they say about air travel?
Airlines stopped having to accept emotional support animals in January 2021. Any site still advertising ESA cabin access is working from stale information.
Which law do they cite for housing?
It's the Fair Housing Act, not the ADA. A service promising 'full ADA protections' for an emotional support animal has the statute wrong, which tells you something about the rest of their advice.
Can you read the refund terms before buying?
Look at the conditions rather than the headline. 'Money-back guarantee' often excludes the case you actually care about, which is a landlord saying no.
